  1. Jurisdiction:

    If the dispute cannot be resolved through mediation, both parties agree that the District Mathura court shall have exclusive jurisdiction over any legal proceedings arising from or in connection with the dispute. Both parties consent to the personal jurisdiction of the District Mathura court and waive any objection to such jurisdiction.
  2. Governing Law:

    These dispute resolution terms shall be governed by and interpreted in accordance with the laws of the District Mathura court.
  3. Costs and Fees:

    Each party shall bear its own costs and expenses incurred in connection with any mediation or legal proceedings, including attorney fees, unless otherwise awarded by the District Mathura court.
  4. Class Action Waiver:

    Both parties agree that any dispute resolution or legal proceedings will be conducted solely on an individual basis and not as a class, collective, or representative action. The parties waive any right to participate in a class or representative action.
  5. Severability:

    If any provision of these dispute resolution terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  6. Waiver:

    The failure of either party to enforce any right or provision of these dispute resolution terms shall not be considered a waiver of that right or provision.
  7. Entire Agreement:

    These dispute resolution terms, together with our Terms of Use and any other applicable policies or agreements, constitute the entire agreement between you and Dayashakti Ayurveda regarding dispute resolution and supersede any prior agreements or understandings.
